The slogans calling out freedom of Kashmir echoed in JNU campus on evening 9th Feb at a ‘cultural’ (!?) Event organised by organisations like AISA, SFI, AISF and whole nation was shocked. I heard the news and started (I won’t say investigate) to read about the event. The more information I encountered more frustrated and enraged I am. The event was marketed as a cultural program where students from JNU gathered giving the dais to ‘Poets’, ‘Artists’ and so called free spirits who were special guest at this gathering. After this the event took a drastic turn, students stood there as if it was (I’m sure it was!) pre planned and started giving slogans against ABVP, I can understand that! But when they started shouting ‘Pakistan Zindabad’ & ‘Kashmir ki Aazadi tak, Desh ki Barbadi tak, Jang Chalegi’ and expressed to fulfil Afzal Guru’s Destily (Arman) making him and Maqbul Butt martyrs, I’m upset. I simply can’t see the logic behind actions of these students of so called rational ideology. JNU campus has always been a Power house of ‘Leftist Movement’. Their Ideological Differences with Nationalist student organisation ABVP are out in the open but slogans against Mother Nation are unacceptable. The antinational and Provocative activities like this were always been an integral part of Leftist Student Activism in JNU, But by their own standards (Which do include Beef Party in past & Protest against Swami Vivekananda Kendra Event) are new Low. The elite advocates of freedom (I’m Talking about you Mr. Kejriwal, Mr. Gandhi and All those who think ‘Democratic Ethos’ are being stooped upon) of speech of these students bring shame to word ‘Intellectual’ which has really lost its value in past months, but still they’ve managed to bring it at a new low! Those mooting about freedom of expression do forget that goons in JNU vowed keep fighting till they destroy Indian State, the very state build on Constitution and the constitution that provides Freedom of Speech! The shameless half baked arguments presented by them further show their incline away from the Spirit of our nation! Babbling again and again about unfair trial of Afzal Guru even each legal remedy, each legal option was exhausted by him is to divert the issue in another direction! Even glorifying death of mastermind, highjacker Maqbul Butt is another way of these opportunists to play victim card in front of the society and to get more ‘Comrades’ to march up behind them on the ‘Red’ path of Anarchy in the name of ‘Freedom of Expression’. As these guys paint the arrest of Kanhaiya Kumar as a threat to democratic ethos they fail to understand that these goons expressed to overthrow same Democracy!! While Rahul Gandi exclaims, "People who suppress the voice of this institution are anti-national." That just highlights the sheer lack of knowledge of him about our National Spirit!! As Arvind Kejriwal orders Magisterial probe for investigation his ambiguous stand makes it clear to me that both of Mr.Gandhi and Mr.Kejriwals intentions to politicize matter, against national pride to bake their bread and melt their butter!! Whatever the media, politicians, those ‘Red’ goons may have to say being a Indian Citizen I do have a fundamental right to condemn those who question the nation, It’s State and Oppose It’s very spirit the Constitution which integrates us as Anti-national. So I stand in protest supporting the crackdown of anti-national acts in JNU to restore Educational environment that promotes National Integration not separatism! Structure and respect not anarchy; Peace and harmony instead of violence and Terrorism! Naturally ABVP being organization of Students like me, feels the same way! and is protesting against the opportunistic grab of these half witted students to grab attention of media by stirring controversy and to propagate Anti-national activities to do so! So “On the ‘Red’ Dusk of ‘Terror’ for the ‘Dawn’ of Integrative and Patriotic atmosphere for education at JNU Here I Stand, The Youth In Revolt!!”

Well picking up from last entry, I've digged a little and I wish to present some statics. To understand the Religious Intolerance the study tool we should use for observation is Religious Violence as it's a (Violent and Extreme) outbreak of Religious Intolerance! The statics from British india (1920-1040) and from Modern times (2005-2009) show significant decrease in number of casualties occurred in Religious Violence. That is excluding the genocides that took place during the Partition. That alone demolishes claim that the Religious Intolerance in india is Growing or is on rise! For our consideration let's see the statics of few recent years the Religious Violence took 93 lives in year 2012 (0.007/100,000) amongst them 48 were Muslims and 44 were Hindus with 1 Policeman killed in line of duty leaving 2,067 injured. The very next year in 2013 the violence claimed 107 lives (0.008/100,000) where 66 were Muslims and 41 were Hindus. Now the people creating a atmosphere are arguing, See the casualties are increased the Religious Intolerance is Rising in Country well to take that in the contrast that same year 1,643 were injured in non Religious Violence including 794 Hindus,703 Muslims and 200 Police personnel. The Deaths in Religious violence are tragic but the total number of Deaths pited against the past ones it tells a different tell! Let's put those numbers in contrast with Anti Sikh Violence in 1984,* 2800 were killed and 2100 were from delhi only why these So called sensitive Intellectuals were silent then? The Sikh brothers were murdered, Sisters were raped the children killed weren't they Citizens of India or It was fine by these Great Thinkers because then the Murderers were belonging to a Certain 'Political' party? It was a Genocide! why the people and media now screaming Intolerance Intolerance silent then? Then the Case of Kashmiri Pandits** the kashmir valley was Home to Pandits, they flourished their long before akbar invaded Kashmir in 1587, Even under his Mughal rule They enjoyed 'Tolerance', Freedom and even were appointed to authority posts. It all started to Spiral downwards after end of Dogra Rule (1846-1947) they occupied a great section of Population in Valley but events from 19 Jan 1990 when Mosques issued a Fatwa Declaring Kashmiri Pandits as "Kafirs" and ordered males to leave Kashmir and also stated and enforced them to leave women and children back to use as sex slaves! Was The Ethnic Cleansing Of Kashmir a Fair or Good Deed? From 140,00 pandits 100,000 fled the Kashmir under the threat of Islamic Extremists,Militants and Terrorists. where were these Intellectuals then? The Case of Khairlanji killings, The ongoing genocide of people in Red corridor, Attacks and killings of Rightist Activists in Kerala all are examples of Intolerance be it Ideological or Religious! as Religion is governed by Ideology! The stories of anti Sikh Riots and Exodus of Kashmiri Pandits From Valley are clear sign of Religious Intolerance! Hell the Exodus was ongoing for over a decade! (1985-1995). The Intolerance is not a newfound thing that suddenly appeared and started growing gradually!! I think the fake and doctored outcry of these Pseudo-Intellectuals about Intolerance is in itself a example of Intolerance towards Ideologies opposing of different than their own! It really shows the Hypocritical , Based and Politically motivated nature of this Intolerance outcry!! Well I've written too much with the facts I found and Statistics that reassured me that the Intolerance isn't increasing or it's not something we created in new millenia! It's a phenomena around for few centuries, and I really shouldn't listen to these "Red" Hooligans but I need to evolve from this situation! Remember, 'When Lie Shouts , Truth must Rore!!' * - For additional reading visit https://en.wikipedia.org/wiki/1984_anti-Sikh_riots ** - For additional reading visit https://en.wikipedia.org/wiki/Kashmiri_Pandit Last month an Indian was lynched and being a secular country we all gave the incident a deep religious and flashy political overtone! The act was inhumane,Violent, Worst of Humanity but we also have to take in account it being blotted and quoted out of context! Whatever happened in Dadri,U.P. wasn't just or humane but the picture Media and all (Pseudo)Intellectuals are painting shows my country n brink of a Civil War! Well as being a responsible part of community I feel it's my responsibility to put and moot some facts about Religious intolerance in India and present my #LucidAngle on the matter! So let's talk Intolerance!! Oxford dictionary defiles, 'Religious Intolerance is intolerance against another's religious beliefs or Practice or Lack thereof'. Well in India Hindus, Buddhists, Jains, Sikhs, Muslims, Parsis, Muslims and Christians have been living for long time. From the emerging of Islam the Fire-Worshipers (Parsis) migrated to india to find Refuge! Then came the Muslim Invaders in 8th Century (Initially in Afghan & Pakistan, Which then was a province of India) The Christians landed here through means of trade and flourished under the British rule. The Jainism, Buddhism and Sikhism are considered as a Branch of Hinduism as they Originated Here in India. The Religion being individual's Identity back then played a great role in social, political and historical development of country. It's True that all religious groups united for cause of uprooting the British Rule and gain freedom, but it's well noted in British Gazette that the Religious Violence (Violent Outburst of Religious Intolerance) was common in British India ! Actually the statistics show the Pri-Division Violence from 1920-1940 resulted in 381 Deaths and Thousands beyond count Injured per year. While pitted against those mentioned above The Statistics of Religious Violence show Incidents in 2005-2009 window resulted in 130 Deaths and 2,200 injured per year. If statistics kept aside the Religious Intolerance isn't a new born seance the interaction between all religious groups the difference between Customs, Rituals and Lifestyle made groups Intolerant of each other the riots erupted then too! It's not something that came into existence now or few months back the partition of our country was due to Religious Intolerance!! but now some people saw it growing with Their 'Red' polaroid lense and decided to cash in on opportunity to hold whole society of india Hostage through their Dramas of returning awards and Fake, Biased and conspired public outcries!! In Next entry I'm going to shed some light on the real Face on these Pseudo-Intellectuals, Stay Tuned !! The trending tag on #Twitter inspired me to write my #LucidAngle about UCC but as I've brainstormed, discussed and sometimes argued over the subject for weeks I saw the glimpse of reality! In 1954 when then PM Jawaharlal Nehru was asked about why Art.44 wasn't implemented, He remarked "I don't think that at the present moment, The time is ripe in India for me to push it through!!" So in short he thought that the great nation of ours lacked the maturity to accept UCC, That was 61 Years ago! During course of Discussion I had with Lawyer and Activist Ray Singh, He remarked a concern that the Majority of demands to imply UCC are because few feel the need to support the good Notion that's All! They don't understand that the Law that prohibits practice of Triple Divorce and polygamy for muslims also ipso facto* Dismisses the "Sat Fere" as a valid condition in view of law to commence Marriage, Both Hindus and Muslims will be Obligated to register their marriages in front of Magistrate are we ready to accept it? Besides that the fact that Parliament has failed to implement Art. 44 (UCC) is because their is no sufficient support for the move whiten the parliament itself! The issue is now riddled with Communal and Political Overtones. Some state that the issue is being overblown to exploit Political or Communal Benefit! Other articles of Constitution that need Priority in implementation are being neglected. Also when taken under wide consideration Art. 44 a "Directive Principle" if implied also violates the fundamental Right given by Art. 25 (Right Of Freedom) In given oblivion the concept of optional UCC has been advocated time and again which if implied gives Free Choice, Facilitate Harmonisation of Social Relationships across country in keeping with changing counters of changing social realities. A tiny state of Goa serves a ambitious option with set of 'Family Laws', Which apply to all communities in Goa and are based on Portuguese Civil Code of 1867. Governing all personal matters such as Marriage, Divorce, Succession, guardianship etc. of Hindus, Muslims and as well as Christians as equal and endorse gender equality! As per what I believe is I've reached a conclusion that The Uniform Civil Code Should and must be Implied in Country to preserve equal stature of individual against the law and make Constitution Sovereign not being affected by any set of personal laws! but it should be done gradually and progressively avoiding any cultural Shock!! So the question we are left with is are we mature enough to let go of our overblown prides and stand equal be four Law, Preserving our diversity, But embracing Our Unity, as a Society of 'India' *Ipso Facto- by that very fact or act / by default. As I've stated before The UCC or Uniform Civil Code is a lingering Dilemma of Indian Democracy. The Mere mention of Art.44 is deemed outrageous by Few People!! The most discussed and commonly known case is of Shah Bano's* case where a poor muslim women claimed for maintenance from her husband under Sec.125 of Cr.P.C after getting triple Divorce by her Muslim husband. SC ruled in her Favour, Chief Justice Chandrachud commenting, "A common civil code will help the cause of national integration by removing disparate loyalties to law which have conflicting ideologies." The Response to the judgement was Prompt,Strong and reactionary. Muslim leaders all over vowed to "Give Lives" Protecting their personal law. this unrest is what caused then PM rajiv Gandhi pass Muslim women's(Protection of Rights in Divorce) act,1986. In another matter of Sarla mangal v. Union of India(AIR 1995 SC 153) Bench headed by Justice Kuldip Singh Readdressed issue reminding then PM P.V.Narasimha Rao to take a fresh look at Art.44 Quoting. "Successive governments have, till date, wholly remiss in their duty of implementing the constitutional mandate under Article 44." In another case in 2003 of a christian Priest From kerala John Vllamatton v. Union of India, AIR 2003 SC 2902 Bench of justice Khare, Observed as under, "It is a matter of great regret that article 44 of Constitution has not been given effect to. Parliament is still to stop in for framing a uniform civil code in country." Contradictory to that when the Petition was filed to mandate Government to initiate UCC in Country, it was dismissed on the ground that this was a matter of Legislature and not the Judiciary.** Chief Justice Chandrachud stating that UCC being Vital for national integration in case of Pannalal Bansilal v. State of AP, (AIR 1996 SC 10230, it was held that Introducing UCC in one go will be Counter productive For nation's Unity and Integrity Even the strong Outbursts of Justice Kuldip Sing were Diluted observing, They were only in nature of Obiter Dicta*** and not legally binding in the government. The Contradictory stand of SC on the Matter of UCC further cements the way for politicians to Thrive upon!! And that's what is happening on the matter frequent media reports few live 'Newshour Debates' ensure that the extreme REligious archetypes will rore then and again and lo and behold we will continue to live a falsified Dream of Equality!! * Mhd. Ahmed Khan V. Shah Bano Begum (AIR 1985 SC 945) ** Maharishi Avadhesh v. Union of India, 1994 SCC Suppl (1) 713) *** Obiter Dicta- a judge's expression of opinion uttered in court or in a written judgement, but not essential to the decision and therefore not legally binding as a precedent. OR an incidental remark. From time and again Indian Media, Citizens of India and It’s politics has dancing around the concept of 'Uniform Civil Code'. The trending tag #UniformCivilCode the news flashes around it tell a story. A story of failure, a story of nonsensical stands and oblivious judgements! The Art. 44 of the Indian Constitution lays down an important directive principle of state policy, namely, that the state shall endeavour to secure for its citizens, a Uniform Civil Code throughout the territory of India. However the Constitution contradicts itself! Stating in Art. 37 that 'Directive principles (similar to Art. 44) are not enforceable by any court although they are Fundamental in Governance of country.' The time being now our government and legislation is governed by personal laws of us citizens. Meaning each religious groups having its own take on common practices like Marriage, Divorce, Adoption and Succession based on their beliefs. For example The practice of monogamy for Majority I.e. Hindus and practice of Polygamy for minorities I.e. Muslims !! The suggestions made in Art. 44 are fairly simple, making an Integrated code of conduct respecting all personal codes i.e. Hindu Law, Muhammadan Law, Christian Law, The Parsi Law so on and so forth, but making all Individuals irrespective of Beliefs & Customs he practices stand on common ground for legal consideration! Former governing party of India Congress issued a press release stating that the issue of Uniform Civil Code being 'sensitive' one they would like to discuss all possibilities with experts and fellow parties. This is what exposes the Dirty hidden agenda of appeasement they’ve used for years!! I’m not against them but appeasing few social groups for own ‘Political’ gain is just wrong!! I stand against that!! The so called Secular people and their secularist brotherhood (I've typed and erased 'Pseudo' prefix for word secular!!) like all Socialists, Communists are silent on the matter!! This being a matter of key importance in National Integration and I Being a Law student, feel obligated to present my #LucidAngle on the matter So I’ve decided to Blog about it for days to come in a series to address the matter in deep!! Comment your #LucidAngles below!! Ref.-'Principles Of HINDU LAW' by Noshirvan H. Jhabvala Pg. no.36-40 Language the very thing that we use to communicate on daily basis is deteriorating! It's a growing concern of mine that I've decided to voice today!
I am fluent in English as well as Hindi and I've tried my hand on learning German and failed but for major part of the day I speak Marathi so I'm going to discuss on Marathi but this goes with each regional language spoken in India. On the one hand we Maharashtrians demand that Marathi should be made a Classical Language or as we say 'अभिजात भाषा' in Marathi. Yet we are most ignorant about it's cultivation, it's use or even maintaining it's status! The language that finds it's origin in Sanskrit the language of Gods as we believe is being morphed into something else entirely. Just take for example when we pick up the phone we exclaim "Hello!", When the occasion to thank anyone rises we utter "Thanks" or "Thank You" instead and the list goes on. I for myself Decided that I'll use as many as Marathi substitutes as possible while speaking! But I'm sad to note that not just my friends but few of my relatives do pick one me for speaking like a Know it all, or as they say in Marathi a 'डुढ्ढाचार्य'! All the mainstream Media, News and also the Web Promoting and in some place advocating the use of these Slangy Urbanized forms of Languages is just ridiculous. It's also easy ot trace their devolution as first the introduction of Texting, Yeah folks it was a thong few years ago mainstreamed short forms or Acronyms, the internet saw that business booming with platforms like Online chatting, Internet messengers like What's app and sites lime Twitter. I'm not at all against it Heck I am proud and frequently brag about my fluency in English but mindfully we need to take few steps towards conservation of languages that are beautiful as it is, With all the ascents they show! But With each and every word spoken now by every one of us we are creating a new language मिंglish a cocktail of English and Marathi and that's toxic for both! It has happened!! Calming #YouthWithFtII All major campuses in Sangamner are closed down for the day including sangamner college, AVCOE & AVPoly , Students are getting escorted out of the campus by security and staff!!
Issue much talked over of FTII is finally acquired by NSUI, they are saying “एफ.टी.आय.आय. के सन्मानमे युवक कोन्ग्रेस मैदान मे!” meaning they act for ‘Respect’ of FTII. Oh Please!! In Respect?? what a joke!! Student of the institute in Question Raves, Smokes, Drinks in (It’s own Educational) Campus, Threatens college administration with pledge of Anarchy, Disrespects National Anthem!! And now NSUI is hitting the streets for ‘Respect’ of such students. Putting a Leash around all colleges unrelated to subject. Even the tactics & antics they used were matter of ridicule. In Nanded they told common students that in a imaginary tragic event A student of FTII has died recently and to honour him they must close colleges, At Sangamner when confronted by a Student the NSUI worker told that he was just doing what he was told and don’t know anything regarding matter, It was a exhibition of a political power for him!! What they’ve achieved doing it besides Confusing masses is beyond my understanding!! #LucidAngles Keywords- FTII; NSUI; What has happened?; Reality Today saw a Ultimatum issued on Facebook by the so called student wing of Congress ‘The NSUI’ about initiating a state-wide College lock-down or कॅालेज बंद to support the agitating students of Film and Television Institute of India. As soon as the post was published and I read about it the one question that came to the mind was ‘Is disrupting academics of all colleges in Maharashtra to show support to ongoing agitation at Pune Wise?’
The students of the institute in question are on Strike close to three months now!! As I believe No new admissions either in hostels or in college are conducted this and past year too!! Students from previous batches have failed to complete their respective courses in given time, The passing rate of IIT’s is better than FTII where by a report Government spends 3.5 laks per student and close to 8 lak being spent on a FTII one. Now the Question I have is simple, Why do amidst of Submissions, Term Ends, Practical’s & prelim Exams, NSUI is forcing its agenda on colleges which clearly aren’t related to the matter Of FTII? Isn’t this immoral!! Aren’t common students going to suffer? Or to achieve a Political Benefit #NSUI is continuing on their path of Nonsense is for Time to determine! #LucidAngles |
